Who deducts and when

Who has to deduct

Any person other than an individual or HUF, plus individuals and HUFs whose accounts were required to be audited in the preceding year, when paying a resident contractor for carrying out work under a contract.

When to deduct

At the time of credit to the contractor's account or payment, whichever is earlier.

Points to remember

  • "Work" includes advertising, broadcasting and telecasting, carriage of goods or passengers by any mode other than railways, catering, and manufacturing or supplying a product to the customer's specification using material bought from the customer.
  • No TDS on payments to a transporter who owns ten or fewer goods carriages at any time in the year and gives a declaration with PAN.
  • If GST is shown separately on the invoice, TDS is generally deducted on the amount excluding GST (CBDT Circular No. 23/2017).
  • Both limits are tested separately: one bill above ₹30,000 triggers TDS even if the yearly total is below ₹1,00,000, and the yearly total crossing ₹1,00,000 triggers TDS on all payments including earlier small bills.

Worked example

A company pays an individual civil contractor ₹1,50,000 (excluding GST) for repair work.

TDS at 1% = ₹1,500.
