For nearly eight years following the rollout of Goods and Services Tax in July 2017, taxpayers aggrieved by first appellate orders had no specialized tribunal to turn to. Taxpayers were forced either to wait under circular protections or approach jurisdictional High Courts through costly writ petitions under Article 226 of the Constitution.

With the operationalization of the Goods and Services Tax Appellate Tribunal (GSTAT), the second appellate forum is now fully active across National and State Benches.

Here is your comprehensive guide to the GSTAT appellate framework, statutory filing timelines, pre-deposit calculation rules, and procedural checklists for filing in Form GST APL-05.

Before approaching GSTAT, understand where your case sits in the 4-tier statutory dispute resolution hierarchy:

GSTAT Filing Deadlines & Transitional Relief

Under Section 112(1) of the CGST Act, any person aggrieved by an order passed by the Appellate Authority (Section 107) or Revisional Authority (Section 108) may appeal to the Appellate Tribunal within three months from the date of communication of the order.

The Special Transitional Deadline:

Because GSTAT benches were constituted after substantial delays, the CBIC introduced statutory transitional relief:

  • For appellate orders communicated prior to the date of tribunal operationalization, the three-month limitation period begins from the date notified by the government for tribunal filings.
  • The Tribunal may condone delays of up to three additional months under Section 112(6) if satisfied that sufficient cause prevented timely filing.

Pre-Deposit Rules: How Much Must Be Paid Upfront?

Under Section 112(8) of the CGST Act, no appeal can be admitted before the Appellate Tribunal unless the appellant deposits the mandatory statutory pre-deposit:

The 2-Part Pre-Deposit Computation:

  1. Full Admitted Amount: 100% of the tax, interest, fine, fee, and penalty arising from the impugned order as is admitted by the appellant.
  2. Disputed Tax Pre-Deposit:
    • First Appellate Level (Section 107): The taxpayer had already deposited 10% of the disputed tax amount (capped at ₹25 Cr CGST).
    • GSTAT Level (Section 112): The taxpayer must deposit an additional 20% of the disputed tax amount (reduced to 10% in recent rationalization amendments for certain categories).
    • The total cumulative pre-deposit across both appellate levels stands at 30% of the disputed tax.

Automatic Stay on Recovery:
The moment the mandatory pre-deposit is paid via electronic cash ledger, recovery proceedings for the remaining 70% balance demand are deemed stayed automatically under Section 112(9) until the tribunal disposes of the appeal.

National Bench vs State Benches: Jurisdiction Rules

GSTAT operates with two distinct tiers of benches:

1. The Principal (National) Bench

Located in New Delhi, presided over by the President and one Technical Member (Centre) and one Technical Member (State).

  • Exclusive Jurisdiction: Hears appeals where one of the issues involved has a place of supply (POS) question.

2. State Benches

Constituted across state capitals and major commercial centers.

  • Jurisdiction: Hears all appeals involving classification, valuation, ITC eligibility, fake invoicing, and procedural demands where place of supply is not the point of dispute.
  • Cases involving disputed tax or ITC up to ₹50 Lakhs with no substantial point of law may be heard by a Single Member Bench.

Frequently Asked Questions (FAQs)

What happens if the Tribunal rules in favor of the taxpayer?

Under Section 115, if the pre-deposit becomes refundable as a consequence of the tribunal’s order in favor of the taxpayer, the government must refund the pre-deposit amount with statutory interest from the date of payment until the date of refund.

Can the tax department also appeal against an order before GSTAT?

Yes. Under Section 112(3), the Commissioner of GST may, if dissatisfied with the First Appellate Authority’s order, direct an officer subordinate to file an application (cross-appeal) in Form GST APL-07 within six months.
