ITR-U is the updated income-tax return used to report eligible additional income or correct certain omissions after the usual return window. In 2026, the updated-return framework allows up to 48 months under the applicable provisions, but the deadline, section number, and clock depend on whether the return relates to an older Assessment Year under the Income-tax Act, 1961 or a Tax Year governed by the Income-tax Act, 2025.

An ITR-U is not a general replacement for a revised return. In the usual case it cannot be used to reduce tax, increase a refund, or report an increased loss, and additional income-tax is payable. Check eligibility and calculate the amount under the law that applies to the relevant year before submitting it.

What is an ITR-U updated return?

An updated return gives an eligible taxpayer a later opportunity to report income or correct certain information—for example, income left out of a return or a return not filed earlier. It may be available whether or not an original, belated, or revised return was filed, subject to the statutory conditions and exclusions.

ITR-U is not intended to claim a fresh refund or reduce the tax liability shown in the earlier return. It also does not replace a revised return that is still available within its ordinary deadline. If the correction reduces tax or increases a refund, check whether a different remedy is available; ITR-U is generally not the route for that result.

The 48-month limit in 2026

The 48-month period is measured from the statutory reference point for the law governing the return. This matters because the Income-tax Act, 2025 applies from 1 April 2026, while earlier Assessment Years remain governed by the Income-tax Act, 1961, even when the filing happens after that date.

Return relates toGoverning frameworkUpdated-return provision
Earlier Assessment Years before Tax Year 2026–27Income-tax Act, 1961Section 139(8A), subject to its applicable 48-month time limit and conditions
Tax Year 2026–27 and laterIncome-tax Act, 2025Section 263(6), within the prescribed 48-month period

Do not determine a last date just by adding four years to the day you filed the original return. Identify the relevant Assessment Year or Tax Year, the governing Act, and the statutory date from which its period is counted. The Income Tax Department’s 2026 FAQs explain that old-Act returns for earlier years continue under the old Act after 1 April 2026.

Additional tax on ITR-U

An updated return generally includes additional income-tax based on the time elapsed in the relevant filing window. The notified 2026 ITR-U form sets out these standard bands on the relevant aggregate tax-and-interest amount:

Filing windowStandard additional income-tax band
First 12 months25%
More than 12 months, up to 24 months50%
More than 24 months, up to 36 months60%
More than 36 months, up to 48 months70%

These percentages are not percentages of the extra income itself. The ITR-U computation starts with the tax and interest payable on the updated income and applies the additional amount as prescribed. The form also provides separate treatment for specified notice cases; therefore, this table is not a substitute for the official ITR-U utility or a case-specific tax calculation.

Who may be unable to file ITR-U?

Eligibility depends on the facts and statutory exclusions. The updated-return route is generally unavailable where it would reduce the total tax liability or create or increase a refund. The law also excludes specified situations involving search or requisition proceedings, certain assessment or reassessment proceedings, and other listed restrictions. The exact list differs by governing provision and can be amended.

Before preparing the form, check:

  • Whether an updated return is permitted for the relevant year and taxpayer.
  • Whether a notice, search, survey, or assessment proceeding affects eligibility.
  • Whether the updated computation increases income and tax in the permitted way.
  • Whether tax, interest, and the applicable additional income-tax have been paid as required.
  • Whether you already filed an updated return for that year; generally, only one updated return is allowed for the tax year.

ITR-U vs revised return vs belated return

Return typeMain useTiming and result
Revised returnCorrect an original or belated return during the ordinary revision windowCan correct eligible mistakes; use the deadline and law for that year
Belated returnFile a return after the original due date, when allowedHas its own filing window and late-fee/interest consequences
Updated return (ITR-U)Report eligible additional income or make allowed updates after ordinary windowsUp to 48 months under the applicable Act, with additional tax and exclusions

An updated return should not be chosen just because it is still technically available. Compare the correction needed with the ordinary revised-return route, notices already received, and the extra tax cost.

A practical ITR-U preparation checklist

  1. Identify the year first. Confirm the Assessment Year or Tax Year and whether the 1961 Act or 2025 Act governs it.
  2. Check the deadline from the correct statutory date. Do not count from the original filing date.
  3. Confirm eligibility. Review the ITR-U instructions and any notices or proceedings affecting the case.
  4. Rebuild the full computation. Include all income, deductions, tax credits, taxes paid, interest, and earlier refunds in the prescribed comparison.
  5. Calculate the additional amount. Use the official form/utility for the correct time band and any notice-specific rule.
  6. Pay and file through the official portal. Keep the acknowledgement, challan, and supporting working papers.

ITR-U FAQs

Can I file ITR-U for a return I never filed?

The updated-return provisions can permit a person to file even when no original, belated, or revised return was filed, subject to all statutory conditions and exclusions.

Can ITR-U be used to claim a refund or reduce tax?

Generally, no. An updated return cannot ordinarily reduce the total tax liability or result in a refund or an increased refund. Check the specific provision and official instructions for the year.

Is ITR-U available for 48 months?

The current framework provides a 48-month period, but identify the applicable Act and calculate the period from its prescribed reference point. Older Assessment Years remain under the old Act.

Does the 2025 Income-tax Act apply to every return filed after April 2026?

No. The Income Tax Department says earlier Assessment Years continue under the Income-tax Act, 1961 even if the return or updated return is filed after 1 April 2026. The new Act governs Tax Year 2026–27 and later, subject to the transition provisions.

Are 25%, 50%, 60%, and 70% charged on the additional income?

No. Those standard bands apply to the prescribed aggregate tax-and-interest calculation, not directly to the amount of extra income. Notice cases can have different treatment.

Can I file more than one updated return for the same year?

Generally, only one updated return may be filed for a tax year. Prepare the correction carefully and use the official utility for that year.
